As per clause 3 of Direct Selling Guidelines and even in Direct Selling Rules 2021 "It shall be the owner, holder, licensee of a trademark, service mark or any other identification mark which identifies the entity with the goods to be sold or supplied or services to be rendered".

Direct selling guidelines issued in Sep 2016 was made by the central government which states that specific state government can also frame rules or guidelines for direct selling entities in their jurisdiction.
